Buybox Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of Buybox.com (the “Website”) and all products, services, and transactions carried out through the Website or any associated channels (collectively, the “Services”). By using Buybox, you agree to comply with and be bound by these Terms.

1. Binding Agreement

• These Terms constitute a legally binding agreement between you (the customer, business, or seller) and Buybox (“Company”, “We”, “Us” or “Our”).
• “You” includes anyone accessing the Website or purchasing products, whether as an individual, business, or entity.
• By using our Website or Services, you confirm that you are legally capable of entering into this agreement and are at least 18 years of age.
• If you act on behalf of a company, you confirm authority to bind that entity.

2. Scope of Services

• Buybox is an importer, distributor, and seller of power tools, machinery, and related accessories.
• We provide both B2B (wholesale/retailers) and B2C (direct customers)
• All products sold through Buybox are subject to availability, quality standards, and warranty policies as described on the Website.

3. Legal Jurisdiction

• These Terms are governed by the laws of India.
• Any disputes arising from use of Buybox services shall be subject to the exclusive jurisdiction of courts in Durgapur, West Bengal, India.
• These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India.

4. Account Registration and Security

• Customers may be required to create an account to access certain services.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify Buybox immediately of any unauthorized use of your account.
• Buybox will not be liable for losses arising from failure to protect your account credentials.

5. Products and Descriptions

• Products are described with the best effort for accuracy, including images, videos, and specifications.
• Minor variations in color, size, or manufacturing do not affect functionality.
• All product pricing, specifications, and availability are subject to change without notice.

6. Orders and Sales

• By placing an order, you offer to purchase the selected product under the terms described.
• Orders are accepted subject to availability and verification of payment details.
• Buybox reserves the right to refuse or cancel orders in case of:
  • Incorrect or incomplete address
  • Out-of-stock products
  • Non-serviceable delivery areas
  • Suspected fraudulent activity
  • COD orders in non-COD eligible zones
• All purchases are binding once payment is confirmed unless explicitly stated otherwise by Buybox.

7. Pricing and Payment Terms

• All prices are in INR and include applicable GST, unless otherwise specified.
• Payment can be made via:
  • Prepaid methods (credit/debit cards, UPI, net banking, wallets)
  • Cash on Delivery (COD)
• Buybox is not liable for delays in payment processing or technical failures.
• EMI payments: Interest charged by the bank is not refundable under any circumstances.

8. Delivery and Logistics

• Standard processing: 1–2 working days post order confirmation.
• Delivery timelines may vary by product category, location, or logistics constraints.
• Buybox uses third-party logistics providers. While we ensure due care, we are not liable for transit delays or damages, but return/refund policies apply.
• Title of goods transfers upon delivery to the logistics provider.

9. Shipping Charges and Taxes

• Applicable shipping and handling charges are displayed during checkout.
• Buybox reserves the right to make partial shipments.
• Customers are responsible for accurate address details; delivery failures due to incorrect information may incur additional charges.

10. Warranty and After-Sales

• Buybox provides brand-specific warranties:
  1. DELI & INGCO: 6 months
  2. XLNT, RUTH, THOR, MSI, and other brands: 6 months service warranty on main components (motors, machinery parts)
• Additional warranty plans are available on registration within 7 days of receipt:
  1. Products < ₹5,000: cost of goods + 20%
  2. Products ≥ ₹5,000: cost of goods + 15%
  3. Products ≥ ₹10,000: cost of goods + 12%
• Warranty excludes:
  1. Accessories, batteries, normal wear and tear, misuse, unauthorized modifications, external damages (fire, water, electrical surge).
• Claims must be made within 3 days of receipt for manufacturer defects.
• Replacement or service is provided only for the same SKU. Customers may either:
  1. Send product to Chennai (transport borne by customer)
  2. Visit nearest authorized service center (service charges reimbursed as per rate card).

11. Returns, Refunds, and Cancellation

• Refunds are processed via RBI-approved payment methods within 2–7 working days.
• COD refunds via NEFT only; ensure bank account accuracy.
• Orders may be canceled by Buybox for:
  • Incorrect address or non-serviceable location
  • Product out of stock
  • Fraud or security concerns
  • Open delivery requests
• Products not eligible for return include:
  • Ticket raised after 72 hours of delivery
  • Product no longer needed
  • Damaged/torn due to customer misuse
  • Incorrect orders or wrong product selection
  • Improper repackaging preventing return
  • Combo items separately
  • Spare parts purchased separately for machines bought elsewhere

12. Intellectual Property

• All content on Buybox (logos, images, text, videos) is proprietary.
• Unauthorized copying, distribution, or commercial use is prohibited.
• Users may not link to illegal or prohibited websites through Buybox.

13. User Conduct

Users must not:

• Provide false, inaccurate, or misleading information
• Defame, harass, or threaten others
• Infringe copyrights, trademarks, or privacy rights
• Access data/systems without authorization

14. Disclaimers and Limitation of Liability

• Buybox does not guarantee product quality beyond manufacturer warranties.
• We are not liable for:
  • Direct, indirect, incidental, or consequential damages
  • Unauthorized access to data
  • Loss of profits, data, or expectations
• Users agree to indemnify Buybox for claims from third parties due to violations of Terms or laws.

15. Privacy

• Customer information (name, phone, email) may be used for:
  • Promotions, updates, or inquiries
  • Customer support and service improvements
• By using Buybox, you consent to collection and usage of personal data as per our Privacy Policy.

16. Modification of Terms

• Buybox reserves the right to update, modify, or amend these Terms at any time.
• Continued use constitutes acceptance of updated terms.

17. Termination

• Buybox may suspend or terminate accounts without prior notice.
• Upon termination, Buybox may delete content or materials associated with your account without liability.

18. Governing Law

• These Terms are governed by Indian law.
• Exclusive jurisdiction lies with courts in Durgapur, West Bengal, India.
